Despite more significant acceptance of LGBTQ community there is still much work to be done when it comes to their rights. Recent Supreme Court rulings decriminalizing homosexuality along with proposals such as same-sex marriage legalization continue being hotly debated within legal circles.
Decriminalization of Homosexuality
In September 2018, Supreme Court of India struck down Section 377 of Indian Penal Code (IPC) which criminalized homosexual act between consenting adults. This was landmark ruling that marked massive step towards equality and inclusivity for LGBTQ community in India.
Same-Sex Marriage Legalization
While the decriminalization of homosexuality was essential victory for the LGBTQ movement, legalizing same-sex marriages remains contentious issue. As per current laws ,marriage is considered only between opposite sexes . However , some states like Kerala have allowed civil partnerships but full recognition across country is yet to happen .
The draft Personal Laws (Amendment) Bill prepared by Ministry Of Law & Justice proposes recognising same sex couples under various personal laws .Though its implementation may take time given social/ religious sensitivities around this subject.
Transgender Rights
Transgender persons are among most marginalized groups in society; often denied basic human rights including access to education or employment opportunities due discrimination faced. While recent legal developments such as NALSA judgment provide important protections against discrimination and violence based on gender identity, this group continues facing many challenges.
Ongoing Challenges
Despite recent progress made towards securing equal rights for members of the LGBTQ Community in India ; discriminatory attitudes & prejudices remain prevalent within certain sections leading to harassment & exclusion from mainstream society. This highlights need for continued advocacy efforts aimed at promoting tolerance & understanding while also pushing forward legislative reforms that would enable greater inclusion .
